An Act concerning eligibility for the "Pharmaceutical Assistance to the Aged and Disabled" program and supplementing P.L.1975, c.194 (C.30:4D-20 et seq.).

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. If a recipient of benefits under the "Pharmaceutical Assistance to the Aged and Disabled" program, established pursuant to P.L.1975, c.194 (C.30:4D-20 et seq.), receives an unanticipated lump sum payment due to inheritance, death benefits, lottery, gambling or games of chance winnings in an amount that would cause the recipient to exceed the income eligibility limit for the program, the recipient shall notify the Division of Medical Assistance and Health Services in the Department of Human Services in a manner prescribed by the division within the calendar year in which the lump sum payment was received, along with information explaining the condition of the unanticipated lump sum payment. The recipient shall not be required to reimburse the program for prescriptions already paid for by the program during the calendar year in which the recipient received the lump sum payment. The recipient may apply for benefits under the program in the calendar year following the year in which the recipient received the lump sum payment.

 

    2. The Commissioner of Human Services shall promulgate rules and regulations pursuant to the"Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.) necessary to carry out the purposes of this act.

 

    3. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill allows a recipient of benefits under the "Pharmaceutical Assistance to the Aged and Disabled" program who receives an unanticipated lump sum payment due to inheritance, death benefits, lottery, gambling or games of chance winnings and who notifies the Division of Medical Assistance and Health Services in the Department of Human Services of the unanticipated lump sum payment in a manner prescribed by the department within the calendar year in which the lump sum payment was received, to not reimburse the program for any prescriptions already paid for by the program during the calendar year in which the lump sum payment was received. The recipient may apply for benefits under the program in the calendar year following the year in which the recipient received the lump sum payment.
