An Act concerning certain former marine law enforcement officers.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. Notwithstanding the provisions of any other law to the contrary, the appointing authority of any county or municipality which has established and maintains a police force and has adopted the provisions of Title 11A (Civil Service) of the New Jersey Statutes and the sheriff of every county may include as duly qualified applicants on its list of eligibles for appointment as a member or officer any person who:

    a. was serving as an officer in good standing in the Bureau of Marine Law Enforcement in the Division of State Police in the Department of Law and Public Safety on June 1, 1996;

    b. has successfully completed the training program and examination conducted by the Division of State Police and has established to the satisfaction of the Superintendent of State Police evidence of mental and physical fitness and ability to perform the duties of an officer in the Bureau of Marine Law Enforcement; and

    c. was terminated for reasons of economy as an officer in the Bureau of Marine Law Enforcement on or after July 1, 1996.

 

    2. The appointing authority of a county or municipality or a county sheriff's office shall notify the Commissioner of Personnel if it elects to include on its list of eligibles for appointment as a member or officer a person meeting the requirements set forth in section 1 of this act. Notice shall be in a manner and form prescribed by the commissioner. If the commissioner determines that the person meets the requirements, the commissioner shall provide for the inclusion of that person on the list of eligibles, notwithstanding that the person has not taken any examination required under the provisions of Title 11A (Civil Service) of the New Jersey Statutes or that a list has already been certified. Any person included on a list of eligibles shall be placed on that list immediately after those persons granted veterans' preference.


    3. Nothing in this act shall be construed as waiving any of the provisions or requirements of P.L.1961, c.56 (C.52:17B-66 et seq.).

 

    4. This act shall take effect immediately and shall expire one year thereafter.

 

 

STATEMENT

 

    This bill provides that officers in the Bureau of Marine Law Enforcement in the Division of State Police who are laid off for reasons of economy may be included on civil service eligibility lists for appointment as county police officers, municipal police officers or sheriff's officers. Under the provisions of the bill, any person who (1) was serving in good standing as a marine law enforcement officer on June 1, 1996, (2) successfully completed the State Police training program and examination, and (3) was terminated for reasons of economy on or after July 1, 1996 may be added to the civil service list of eligible candidates for appointment as a county or municipal police officer or sheriff's officer. The appointing authority would notify the Commissioner of Personnel if it decided to include on its list of eligibles a terminated marine law enforcement officer. If the commissioner determines that the person is qualified, the commissioner shall provide for the inclusion of that person on the list of eligibles even though a list has already been certified and the person has not taken the required civil service examination. Any person included on a list of eligibles would be placed on that list immediately after those persons granted veterans' preference.

    This act shall not be construed as eliminating the requirement that persons holding a probationary appointment as a police officer must complete a police training course.

    This act shall take effect immediately and shall expire one year thereafter.
