An Act concerning certain voter registration information and supplementing chapter 31 of Title 19 of the Revised Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. a. No later than October 15 of each year, the Secretary of State shall provide a report to the Governor and the Legislature that includes, but is not limited to:

    (1) the total number of registered voters Statewide, including the number of registrants removed from the registry list of each county for not voting in two consecutive general elections for federal office, at the time of the federal general election two years prior to the most recent federal general election;

    (2) the total number of registered voters Statewide, including the number of registrants removed from the registry list of each county for not voting in two consecutive general elections for federal office, at the time of the most recent federal election;

    (3) the total number of new valid registrations filed Statewide between the two most recent federal general elections, including all such registrations that are new within a county or filed by a registrant who moved from one county to another but exclusive of all voter registration applications that are deemed duplicates, rejected for any reason or that report only a change of name, change of address within the county by a person who registered previously in that county or change of party affiliation;

    (4) the total number of registered voters Statewide removed from the registry list of each county for not voting in two consecutive general elections for federal office as of the most recent federal general election;

    (5) the total number of registered voters Statewide removed from the registry list of each county for any reason between the two most recent federal general elections;

    (6) the total number of voter registration applications filed in each county and Statewide in the aggregate, regardless of whether such applications have been deemed duplicates, rejected for any reason or report a change of name, change of address within the county by a person who registered previously in that county or change of party affiliation, that were received from or generated through:

    (a) each of the offices of the Division of Motor Vehicles;

    (b) each of the offices of each voter registration agency, as defined pursuant to section 26 of P.L.1994, c.182 (C.19:31-6.11); and

    (c) all other means, including, but not limited to, voter registration drives that deliver completed voter registration applications to the commissioner of registration of a county;

    (7) the total number of voter registration applications deemed duplicates in each county and Statewide in the aggregate between the two most recent federal general elections that were received by the commissioner of registration of each county and were received from or generated through each of the categories described in subparagraphs (a) through (c) of paragraph (6) of this subsection; and

    (8) the total number of confirmation notices mailed out Statewide between the two most recent federal general elections and the number of responses received Statewide to those notices during the same period.

    b. The Secretary of State shall promulgate, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), such rules and regulations as necessary to effectuate the purposes of this act, and shall have the authority to make such arrangements with voter registration agencies and other relevant public entities as may be necessary to gather and tally the information required by this act.

 

    2. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill requires the Secretary of State to report to the Governor and Legislature no later than October 15 of each year on voter registration activities that have occurred within the State and each county during the previous year.

    Specifically, the bill gives the Secretary of State authority to make such arrangements with voter registration agencies and other relevant public entities as may be necessary to gather and tally information on:

    1) the total number of registered voters Statewide, including the number of registrants removed from the registry list of each county for not voting in two consecutive general elections, at the time of the most recent federal election and next most recent federal general election;

    2) the total number of new valid registrations filed Statewide between the two most recent federal general elections, exclusive of such applications deemed duplicates, rejected or which report only a change in name, address or party affiliation;

    3) the total number of registered voters removed from the registry list of each county for not voting in two consecutive general elections for federal office and the total number of registered voters removed from the registry list of each county for any reason;

    4) the total number of voter registration applications filed in each county and Statewide in the aggregate that were received from or generated through each of the offices of the Division of Motor Vehicles and each voter registration agency and by all other means; and

    5) the total number voter registration applications deemed duplicates in each county and Statewide in the aggregate and the total number of confirmation notices mailed out Statewide between the two most recent federal general elections.

    This bill is modeled after federal regulations designed to implement the "National Voter Registration Act of 1993," (Pub.L.103-31), popularly known at the "motor-voter" act, which require each state to provide certain voter registration information biennially.
