An Act concerning snow removal and supplementing chapter 65 of Title 40 of the Revised Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. a. No snow plow operator shall plow snow from private property onto a public street or roadway.

  b. A person violating this act shall be fined not less than $50 or more than $100 for a first offense, and not less than $100 or more than $200 for a second or subsequent offense.

 

    2. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill would help prevent the obstruction of public roadways by prohibiting snow plow operators from depositing snow plowed from private driveways and parking lots on public roads. On a recurring basis during the "Blizzard of 1996," private operators plowed snow from private property onto the public streets. This impeded traffic and frequently obstructed roadways that had just been cleared by public crews, which were required to re-plow these streets at considerable expense. Further, until the public plows were able to return, deposited snow created a hazardous condition for motorists. This bill would prevent a recurrence of this potentially dangerous situation from repeating itself during future snowstorms.
