An Act concerning the disposal of forfeited property in certain circumstances and supplementing chapter 64 of Title 2C of the New Jersey Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. a. Notwithstanding the provisions of N.J.S 2C:64-6 and N.J.S.2C:64-7, any money seized or any monies received from the sale of forfeited property in connection with a violation of chapter 35 of Title 2C which occurs on premises operated by a housing authority shall be returned to the housing authority.

    b. Monies received by a housing authority pursuant to subsection a. shall be used for the following purposes and in the following order:

    (1) to refurbish the unit or units from which the property was seized, provided that the tenants have vacated the unit or units;

    (2) for general maintenance and beautification projects on the housing authority property from which the goods were seized.

 

    2. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill provides that any money seized or any monies received from the sale of any forfeited property seized by law enforcement during a drug raid on premises operated by a housing authority shall be returned to the housing authority. The bill specifies that the monies shall be used exclusively for refurbishing the unit or units from which the property was seized if the tenants have vacated; and for general maintenance and beautification projects.


                             

Directs that money from proceeds of drug offenses at housing projects be returned to housing authority for refurbishing, maintenance and beautification projects.
