An Act concerning sewage sludge, and supplementing P.L.1977, c.74 (C.58:10A-1 et seq.).

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. No permit may be issued to the owner or operator of a facility for the processing or disposing of sewage sludge pursuant to section 6 of P.L.1977, c.74 (C.58:10A-6) if that facility accepts sewage sludge from outside the municipality or county in which the facility is located, unless the person applying for the permit demonstrates that the governing body of the county and the municipality in which the facility is situated has, by resolution or ordinance, as appropriate, approved the acceptance of sewage sludge from outside the county and municipality. This section shall not apply to the owner or operator of a facility which has received a permit prior to the effective date of this act or which only dewaters, land applies, composts or stabilizes sewage sludge as approved by the Department of Environmental Protection.

 

    2. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill would prohibit the issuance of a permit to the owner or operator of a facility for the processing or disposing of sewage sludge pursuant to section 6 of P.L.1977, c.74 (C.58:10A-6) if that facility accepts sewage sludge from outside the county or municipality in which the facility is located, unless the person applying for the permit demonstrates that the governing body of the county and municipality in which the facility is situated has, by resolution or ordinance, approved the acceptance of sewage sludge from outside the county and municipality. The bill would not apply to any facility that has been permitted prior to the bill's effective date.


 

Requires local approval for the processing or disposing of sewage sludge from another area.
