An Act concerning death and disabilities caused by job-related stress and supplementing chapter 15 of Title 43 of the Revised Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. Death or disability caused by the physical or psychological impact of stress arising in the course of employment shall constitute a compensable condition for the purposes of chapter 15 of Title 43 of the Revised Statutes. Stress arising in the course of employment shall include stress caused by a permanent termination of employment without a commitment to rehire the employee, unless the termination is because of employee misconduct or the employee was notified when hired that the employment was of limited duration.

 

    2. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill provides that death or disability caused by the physical or psychological impact of job-related stress constitutes a compensable condition under workers' compensation. The bill also provides coverage for stress-related death or disability caused by a permanent termination of employment, unless the termination is because of employee misconduct or the employee was notified when hired that the employment was of limited duration.
