An Act authorizing reimbursement to certain municipalities for expenses in conjunction with the disposal of deer carcasses and supplementing Title 27 of the Revised Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. As used in this act:

    "Expenses" means the full cost of materials, supplies, and labor, incurred by a municipality, which are directly and specifically attributable to the removal and disposal of deer carcasses by the municipality;

    "Department" means the Department of Transportation.

    "Highways or roads" means State, county, or municipal highways or roads.

 

    2.    A municipality which incurs expenses attributable to the removal of deer carcasses on highways or roads within the corporate boundaries of the municipality may apply to the department for reimbursement of those expenses on a form prepared by and available from the department. The application form shall require from the municipality all information the department deems relevant to perform its responsibilities under this act, including but not limited to a list of the itemized expenses incurred by the municipality which are directly and specifically attributable to the removal of deer carcasses.

 

    3.    A municipality applying for reimbursement under section 2 of this act shall submit an application which is certified as to accuracy by the chief financial officer of the municipality.

 

    4.    The department shall review all complete, certified application forms submitted to it. Within 30 days of receiving a completed, certified form, the department shall reimburse the municipality for the amount of expenses certified by the municipality.

 

    5.    a. Any funds reimbursed to a municipality pursuant to this act shall be credited by that municipality to the municipal account or accounts used to pay the expenses of deer carcass removal.

    b. Notwithstanding the provisions of any law, rule, or regulation to the contrary, the funds reimbursed to a municipality pursuant to this act shall not be subject to the provisions of P.L.1976, c.68 (C.40A:4-45.1 et seq.), with respect to limitations on expenditures by municipalities.

 

    6.    This act shall take effect 90 days following enactment.

 

 

STATEMENT

 

    This bill requires the Department of Transportation to reimburse municipalities for expenses they incur in the removal and disposal of deer carcasses found on State, county, and municipal highways or roads within their corporate boundaries.

    Under the bill, a municipality would apply for reimbursement of expenses to the department on a form prepared and made available by the department. A municipality would be required to submit a completed application form certified by its chief financial officer and would then be reimbursed within 30 days by the department.
