An Act concerning certain site improvement standards for residential development and supplementing P.L.1993, c.32 (C.40:55D-40.1 et seq.).

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. In addition to the requirements of section 4 of P.L.1993, c.32 (C.40:55D-40.4), the Site Improvement Advisory Board shall, no later than 180 days following the effective date of P.L. , c. (C. ) (pending before the Legislature as this bill), prepare and submit to the commissioner recommendations for Statewide minimum standards governing the planting of shade trees in residential developments. The recommendations shall include a provision that, in residential developments, trees shall be planted in at least 25% of the total area of the development, along streets and roads, and shall be spaced not more than 40 feet apart.

    The recommendations shall be reviewed, and regulations established, according to the same process set forth in subsection b. of section 4 of P.L.1993, c.32 (C.40:55D-40.4) governing the establishment of site improvement standards. A municipality or developer seeking a waiver of any standard adopted pursuant to this section shall follow the same procedure currently in effect for the granting of a waiver of site improvement standards set forth in subsection c. of section 4 of P.L.1993, c.32 (C.40:55D-40.4). The Site Improvement Advisory Board shall annually review the regulations adopted pursuant to this section and recommend any changes to those regulations in the same manner as is currently provided for site improvement standards as set forth in subsection d. of section 4 of P.L.1993, c.32 (C.40:55D-40.4).


    2. This act shall take effect on the first day of the month next following enactment.

 

 

STATEMENT

 

    This bill requires the Site Improvement Advisory Board, no later than 180 days following the effective date the bill, to prepare and submit to the commissioner recommendations for Statewide minimum standards governing the planting of shade trees in residential developments. The recommendations must include a provision that, in residential developments, trees shall be planted in at least 25% of the total area of the development, along streets and roads, and be spaced not more than 40 feet apart.
