An Act concerning smoking in certain correctional facilities and supplementing chapter 1B of Title 30 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. The Commissioner of Corrections shall promulgate rules to phase-in a prohibition on the smoking of tobacco in State and county correctional facilities and on their grounds within 18 months of the effective date of this act. The rules shall be applicable to all correctional facilities and grounds which are owned, leased or occupied by the State and the counties’ and under the department's and the counties’ jurisdiction.
2. This act shall take effect immediately.
STATEMENT
This bill would ban all smoking in all county and Department of Corrections (DOC) correctional facilities and on all adjacent property.
Its purpose is to safeguard the health of staff and inmates from the risks posed by possible inhalation of secondary tobacco smoke.
The DOC instituted a limited indoor smoking ban in September, 1994.
