An Act concerning the hiring of certain class two special police officers in certain municipalities and supplementing chapter 14 of Title 40A of the New Jersey Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. a. A municipality with a population of 5,000 persons or less, according to the latest federal decennial census, which has adopted Title 11A, Civil Service, may appoint or continue to employ as a police officer, a person qualified as a class two special police officer even though the person is not or was not on a special reemployment list for the law enforcement title to be filled, notwithstanding paragraph (3) of subsection b. of section 1 of P.L.1991, c.299 (C.40A:14-180).

    b. The power of a municipality to appoint under subsection a. of this section shall expire on the last day of the sixth month next following the effective date of this act.

 

    2. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill permits a small municipality to hire or continue the employment of a class two special police officer as a regular police officer, even though the municipality has adopted Title 11A, Civil Service, and the special police officer is not, or was not, on a special reemployment list for the job title. This bill is intended to aid small municipalities, such as Pohatcong Township in Warren County, that do not have the number of qualified candidates for these positions as larger municipalities. A municipality's power to appoint pursuant to the new section would expire in about six months from the date of enactment.
