STATEMENT TO

ASSEMBLY SUBSTITUTE FOR

ASSEMBLY, No. 2368

with Assembly Floor Amendments

(Proposed By Assemblywoman VANDERVALK)

ADOPTED: JUNE 5, 1997

This amendment exempts a hospital owned and operated by a county from the procedural requirements of this substitute (i.e., public notice and public hearings, establishment of a nonprofit charitable trust, and hiring of an independent health care access monitor) regarding a transaction which would convert the hospital to a for-profit facility, but requires that such a transaction be subject to review and approval by the Attorney General based upon his finding that the transaction would not adversely affect the quality, availability or accessibility of health care services in the affected communities and would otherwise be in the public interest.
