An Act concerning the packaging of certain food items and supplementing Title 56 of the Revised Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. No person shall sell or offer to sell to a person under the age of 18 any food, candy or confectionary product that is packaged in a design or shape that is routinely used in the packaging of cigarettes.

 

    2. A violation of this act shall be punishable by a civil penalty of not more than $100. The second and any subsequent violation shall be punishable by a civil penalty of not more than $200.

 

    3. The Director of the Division of Consumer Affairs in the Department of Law and Public Safety shall adopt rules and regulations pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), as are necessary to effectuate the purposes of this act.

 

    4. This act shall take effect on the first day of the second month after enactment.

 

STATEMENT

 

    This bill provides that no person shall sell or offer to sell to a person under the age of 18 any food, candy or confectionary product that is packaged in a design or shape that is routinely used in the packaging of cigarettes. Violators are subject to a penalty of not more than $100 for a first violation and not more than $200 for any subsequent violation.
