An Act concerning the sale of alcoholic beverages in certain cases and amending P.L.1947, c.94.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Section 8 of P.L.1947, c.94 (C.33:1-12.20) is amended to read as follows:
8. Nothing in this act shall prevent the issuance, in a municipality, of a new license to a person who operates a hotel or motel containing 100 guest sleeping rooms or who may hereafter construct and establish a new hotel or motel containing at least 100 guest sleeping rooms, or to a person who operates a racetrack for horse racing.
A license issued under the provisions of this section shall not be counted in determining the number of licenses under P.L.1968, c.277 (C.40:48-2.40 et seq.).

2. This act shall take effect on the first day of the seventh month after enactment.
STATEMENT
This bill would authorize a municipality to issue a retail liquor license to a privately owned racetrack which would not be counted toward the maximum number of liquor licenses the municipality is permitted by law to issue. Under section 2 of P.L.1947, c.94 (C.33:1-12.14), the maximum number of liquor licenses issued is based upon the population of a municipality. Currently there are three privately owned racetracks in New Jersey, at Freehold, Atlantic City and Cherry Hill.
Permits municipality to issue additional liquor license for racetrack.
