An Act concerning paid leave of absence for National Guard duty and amending N.J.S.38A:4-4.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. N.J.S.38A:4-4 is amended to read as follows:

    38A:4-4. (a) All officials and employees of this State or of any board or commission of the State or of any county, school district or municipality who are members of the organized militia of this State or of another state shall be entitled to leave of absence from their respective duties without loss of pay or time on all days during which they shall be engaged in active duty, active duty for training or other duty ordered by the Governor of this State or of another state; provided, however, that the leaves of absence for active duty or active duty for training shall not exceed 90 days in the aggregate in any one year.

    (b) Leave of absence for such military duty shall be in addition to the regular vacation allowed such officers and employees by the State, county or municipal law, ordinance, resolution, or regulation.

    2. This act shall take effect immediately.

 

 

STATEMENT

 

    At present, New Jersey public employees who are members of this State's National Guard are entitled to a paid leave of absence for active duty or active duty for training in connection with their National Guard service. New Jersey public employees who are member's of another state's National Guard are not entitled to such a paid leave of absence. This bill would extend a paid leave of absence for National


Guard service to public employees who are members of another state's National Guard.
