ASSEMBLY CONCURRENT RESOLUTION No. 108

A Concurrent Resolution proposing an amendment to Article VII, Section II, paragraph 1 of the Constitution of the State of New Jersey.

 

    Be It Resolved by the General Assembly of the State of New Jersey (the Senate concurring):

 

    1. The following proposed amendment to the Constitution of the State of New Jersey is hereby agreed to:

 

PROPOSED AMENDMENT

 

    Amend Article VII, section II, paragraph 1 to read as follows:

     l. County prosecutors shall be nominated and appointed by the Governor with the advice and consent of the Senate. Their term of office shall be five years and they may be appointed to two terms of office only, and they shall serve until the appointment and qualification of their respective successors.

    2. When this proposed amendment to the Constitution is finally agreed to pursuant to Article IX, paragraph 1 of the Constitution, it shall be submitted to the people at the next general election occurring more than three months after the final agreement and shall be published at least once in at least one newspaper of each county designated by the President of the Senate, the Speaker of the General Assembly and the Secretary of State, not less than three months prior to the general election.

 

    3. This proposed amendment to the Constitution shall be submitted to the people at that election in the following manner and form:

    There shall be printed on each official ballot to be used at the general election, the following:

    a. In every municipality in which voting machines are not used, a legend which shall immediately precede the question, as follows:

    If you favor the proposition printed below make a cross (X), plus (+) or check (•) in the square opposite the word 'Yes.' If you are opposed thereto make a cross (X), plus (+) or check (•) in the square opposite the word 'No.'

    b. In every municipality the following question:

  Shall the amendment to Article VII, section II, paragraph 1 of the Constitution, agreed to by the Legislature, be adopted so that county prosecutors may be appointed to serve only two terms of five years per term?

 

 

INTERPRETIVE STATEMENT













 

NO

  This proposed constitutional amendment would limit county prosecutors to two terms of office of five years per term. County prosecutors are nominated and appointed by the Governor with the advice and consent of the Senate. Presently the Constitution specifies that a county prosecutor's term of office is for five years but does not specify how many terms a prosecutor may serve. This amendment limits them to two terms of office. The provision that they serve until the appointment and qualification of their successors is not changed.

 

 

STATEMENT

 

    Article VII, section II, paragraph 1 of the New Jersey Constitution provides that county prosecutors are nominated and appointed by the Governor with the advice and consent of the Senate. Their term of office is five years. This proposed constitutional amendment would provide that a county prosecutor may be appointed to serve only two terms of office. The term is five years. The provision that prosecutors in office serve until the appointment and qualification of a successor is not changed.
