An Act concerning certain maintenance costs for mentally ill and developmentally disabled patients in State institutions.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. If a county of the first class with a population greater than 775,000 and less than 800,000 according to the 1990 federal decennial census, has taken credits on charges to the county from the State for maintenance costs for mentally ill patients and developmentally disabled federal Medicaid and Medicare recipients in State institutions, pursuant to court orders, the State shall 1[waive any outstanding repayment by the county for those credits] require a repayment structure which shall be determined by the Commissioner of Human Services in consultation with the State Treasurer, but under no circumstances shall any payments be required prior to January 1, 1999; nor shall the repayment structure set a term of repayment of less than five years1.

 

    2. This act shall take effect immediately.
