ASSEMBLY RESOLUTION No. 146

 

STATE OF NEW JERSEY

An Assembly Resolution urging the State Board of Education to reject the proposed regulations implementing the "Comprehensive Educational Improvement and Financing Act of 1996."

 

Whereas, The Commissioner of Education has proposed to the State Board of Education new regulations to implement the provisions of the "Comprehensive Educational Improvement and Financing Act of 1996," P.L.1996, c.138, approved on December 20, 1996; and

Whereas, In two public hearings, the proposed regulations have been severely criticized by school officials who are responsible for preparing budgets under the guidelines of the proposed regulations; and

Whereas, It has been alleged that the proposed regulations do not adequately reflect legislative intent on a number of key issues relating to the calculation and preparation of a local school district budget; and

Whereas, In addition, it appears that the proposed regulations grant to the Commissioner of Education and to the county superintendents more authority over local district budgets and the budgetary process than the Legislature intended; and

Whereas, The State Board of Education should consult with the Legislature in revising the proposed regulations to implement the new school funding statute and should make certain that the regulations are consistent with the legislative intent of that statute; now, therefore,

 

    Be It Resolved by the General Assembly of the State of New Jersey:

 

    1. This House urges the State Board of Education to reject the proposed regulations implementing the "Comprehensive Educational Improvement and Financing Act of 1996," P.L.1996, c.138, and to consult with the Legislature in order to ensure that the revised regulations properly reflect legislative intent.


    2. Duly authenticated copies of this resolution, signed by the Speaker of the General Assembly and attested by the Clerk thereof, shall be transmitted to the State Board of Education and to the Commissioner of Education.

 

 

STATEMENT

 

    This resolution urges the State Board of Education to reject the proposed regulations implementing the "Comprehensive Educational Improvement and Financing Act of 1996," P.L.1996, c.138, and to consult with the Legislature in order to ensure that the revised regulations properly reflect legislative intent.
