ASSEMBLY RESOLUTION No. 47

      The Assembly Housing Committee reports favorably Assembly Resolution No. 47.

      This Assembly resolution would reconstitute the Assembly task force to study homeowner’s associations which was created during the latter part of the 1994-95 Legislative session by Assembly Resolution No. 92 of 1995. The task force’s mission is to study and make recommendations as to whether any revision of the laws applicable to condominiums or other forms of common interest ownership is necessary.

      The reconstituted task force would consist of 10 members, who are to be appointed by the Speaker of the General Assembly. Three members are to be members of the General Assembly and may not all be of the same party. There are to be seven public members: one is to represent the interests of condominium management associations; one is to represent builders of planned real estate developments; one is to represent condominium associations; one is to represent associations governing units of town home construction; one is to be an attorney with knowledge of housing and condominium laws; and two are to be individuals with general knowledge of homeowner associations and their functions. The Speaker of the General Assembly is to appoint a chairperson from among the task force members; the Speaker would not be prevented by the bill from also appointing a vice-chairperson. The members of the task force are to appoint a secretary who need not be a member of the task force. Vacancies in the membership are to be filled in the same manner as the original appointments were made. The members shall serve without remuneration but shall be eligible for reimbursement of their necessary expenses.
