An Act concerning State psychiatric hospitals and supplementing Title 30 of the Revised Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. a. The State shall reimburse each municipality in which a State psychiatric hospital is located for its documented public safety costs associated with protecting the residents and property of the municipality against patients who leave the premises of the hospital without authorization, in accordance with the following provisions:

The governing body of a municipality in which a State psychiatric hospital is located shall submit to the Commissioner of Human Services no later than the 60th day after the end of the municipal fiscal year, on a form and in a manner to be prescribed by the commissioner, its documented costs which are eligible for reimbursement pursuant to subsection a. of this section.

    c. The commissioner shall certify to the State Treasurer the amount to be paid to each municipality pursuant to this act.

    d. The State Treasurer shall reimburse each municipality no later than the 60th day after receipt by the commissioner of the municipality's documented costs pursuant to subsection b. of this section.

    e. The monies received by a municipality pursuant to this act shall be used by the municipality for any public safety purpose for which tax revenues of the municipality may be expended.

 

    2. The Commissioner of Human Services, in accordance with the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), shall adopt rules and regulations to effectuate the purposes of this act.

 

    3. This act shall take effect immediately.


STATEMENT

 

    This bill requires the State to reimburse each municipality in which a State psychiatric hospital is located for its documented public safety costs associated with protecting the residents and property of the municipality against patients who leave the premises of the hospital without authorization.
