An Act establishing a pinelands enterprise zones pilot program to assist in the economic revitalization of the pinelands area, supplementing P.L.1983, c.303 and making an appropriation therefor.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. a. Within 90 days of the effective date of this act, the New Jersey Urban Enterprise Zone Authority established pursuant to P.L.1983, c.303 (C.52:27H-60 et seq.), hereinafter, the "authority," shall designate areas for pinelands enterprise zones as part of a pilot program under the provisions of this act.

    b. In designating the areas for the pinelands enterprise zones, the authority shall not designate any municipality or area within a municipality which has been designated as an urban enterprise zone prior to the effective date of this act. In designating an area for a pinelands enterprise zone, the authority shall utilize the following criteria:

    (1) The designated area shall not be located in a growth area, as designated pursuant to the Comprehensive Management Plan adopted pursuant to section 7 of P.L.1979, c.111 (C.13:18A-8); and

    (2) The designated area shall be located in a municipality with a population, as calculated pursuant to the latest federal decennial census, of at least 4,000 persons.

 

    2. The authority shall, after consultation with the Division of Economic Development in the Department of Commerce and Economic Development, and after consultation with the Pinelands Commission, promote the development of pinelands enterprise zones for the purpose of attracting new businesses and jobs and retaining existing businesses and jobs within the zones through the use of awards, credits and incentives authorized pursuant to section 4 of this act, including, but not limited to, the partial exemption from the tax


imposed under the "Sales and Use Tax Act," P.L.1966, c.30 (C.54:32B-1 et seq.).

 

    3. Within 24 months after the designation of the areas for the pinelands enterprise zones pursuant to subsection b. of section 1 of this act, the authority shall, after consultation with the Division of Economic Development in the Department of Commerce and Economic Development, and the Pinelands Commission, report to the Governor and the Legislature on the success of the pinelands enterprise zones pilot program authorized pursuant to this act, including the cost of the program, the number of businesses assisted by the program, the number of new jobs created under the program, and any recommendations regarding the need for legislation to adopt the pinelands enterprise zones program on a permanent basis.

 

    4. The authority shall, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), adopt any rules and regulations deemed necessary to effectuate the purposes of this act.

 

    5. There is appropriated from the General Fund to the New Jersey Urban Enterprise Zone Authority the sum of $100,000 to effectuate the purposes of this act.

 

    6. This act shall take effect on the 90th day following enactment and shall expire on the 90th day following submission of the authority's report and recommendations to the Governor and Legislature pursuant to section 3 of this act.

 

 

STATEMENT

 

    This bill establishes a pinelands enterprise zones pilot program to facilitate business and job attraction and retention within the pinelands area.

    The New Jersey Urban Enterprise Zone Authority is required to designate sites for the location of pinelands enterprise zones, and is thereafter required to promote the development of the pinelands enterprise zones pilot program, after consultation with the Division of Economic Development in the Department of Commerce and Economic Development and the Pinelands Commission, for the purpose of attracting new businesses and jobs and retaining existing businesses and jobs within the zones through the use of awards, credits and incentives provided pursuant to the existing urban enterprise zone program.

    Within two years following designation of the sites pursuant to the act, after consultation with the Division of Economic Development and the Pinelands Commission, the authority shall report to the Governor and the Legislature on the success of the pilot program and shall include the cost of the program, the number of businesses assisted by the program, the number of new jobs created under the program, and any recommendations regarding the need for legislation to adopt the pinelands enterprise zones program on a permanent basis.

    The bill also appropriates $100,000 to the New Jersey Urban Enterprise Zone Authority to effectuate the provisions of the act.
