An Act concerning 1[public school curriculum and supplementing chapter 35 of Title 18A of the New Jersey Statutes] the construction of destructive devices and amending P.L.1983, c.2291.

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

1[1. a. No teaching staff member shall use any visual aid or instruct any student on the methods used to make any explosives, including any bomb, shell or similar device filled with one or more explosives, or knowingly permit any student to view any visual aid or recieve information on the methods used to make any explosives, including any bomb, shell or similar device filled with one or more explosives.

    b. Any person who violates the provisions of this act shall be guilty of a crime of the fourth degree.]1

 

    11. Section 1 of P.L.1983, c.229 (C. 2C:39-14) is amended to read as follows:      

    1. a. Any person who teaches or demonstrates to any other person the use, application, or making of any firearm, explosive or destructive device, or technique capable of causing injury or death to a person, knowing or having reason to know or intending that it will be employed for use in, or in furtherance of, an illegal activity is guilty of a crime of the second degree.

    b. Any person who assembles with one or more persons for the purpose of training with, practicing with, or being instructed in the use of any firearm, explosive or destructive device, or technique capable of causing injury or death to a person, intending to unlawfully employ it for use in, or in furtherance of, an illegal activity is guilty of a crime of the second degree.

    c. 2[Any person who teaches a student enrolled in a public or private elementary or secondary school how to construct a destructive device is guilty of a crime of the fourth degree] No teaching staff member, in the course of his professional duties, shall provide instruction on how to create a destructive device to a student enrolled in a public or private elementary or secondary school, for purposes other than as a part of the approved curriculum. Any person who violates this subsection is guilty of a crime of the fourth degree2 . The provisions of this subsection shall not be construed to infringe on the rights of law enforcement officers in the performance of their duties.1

    2. This act shall take effect immediately.

 

 

 

Prohibits instruction to students on methods to make destructive devices.
