      The Senate Education Committee reports favorably and with committee amendments Senate Bill No. 228.

      As amended, this bill provides that any person who teaches a student enrolled in a public or private elementary or secondary school how to construct a destructive device would be guilty of a crime of the fourth degree. The provisions of the bill are not to be construed to infringe on the rights of law enforcement officers in the performance of their duties.

      The committee adopted an amendment which adds the prohibition to an existing section of the criminal code dealing with destructive devices rather than to the curriculum chapter of the education statutes and which makes the bill applicable to any person rather than to a teaching staff member.

      This bill was pre-filed for introduction in the 1996 session pending technical review. As reported, the bill includes the changes required by technical review, which has been performed.

      With the Senate committee amendment, this bill is identical to A356 (2R).
