An Act concerning certain Casino Control Commission and Division of Gaming Enforcement employees and amending P.L.1977, c.110.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. Section 54 of P.L.1977, c.110 (C.5:12-54) is amended to read as follows:

    54. Organization and Employees. a. The commission may establish, and from time to time alter, such plan of organization as it may deem expedient, and may incur expenses within the limits of funds available to it.

    b. The commission shall elect annually by a majority of the full commission one of its members, other than the chairman, to serve as vice-chairman for the ensuing year. The vice-chairman shall be empowered to carry out all of the responsibilities of the chairman as prescribed in this act during his absence, disqualification, or inability to serve.

    c. The commission shall appoint an executive secretary who shall serve at its pleasure and shall be responsible for the conduct of its administrative affairs. No person shall be eligible for such appointment unless he shall have at least 5 years of responsible experience in public or business administration or possesses broad management skills.

    d. The commission may employ such other personnel as it deems necessary. All employees of the commission, except for [secretarial and clerical] division directors, executive assistants and other executive-level management personnel, shall be in the [unclassified] competitive division of the career service of the Civil Service. [All employees of the commission shall be deemed confidential employees for the purposes of the "New Jersey Employer-Employee Relations Act" (P.L.1941, c.100; C.34:13A-1 et seq.), as amended.] If layoff actions are instituted, the commission shall be the layoff unit and the Commissioner of Personnel shall determine job locations within the commission. Notwithstanding the provisions of any other law to the contrary, the commission may employ legal counsel who shall represent the commission in any proceeding to which it is a party, and who shall render legal advice to the commission upon its request. The commission may contract for the services of other professional, technical and operational personnel and consultants as may be necessary to the performance of its responsibilities under this act. Members and employees of the commission shall be enrolled in the Public Employees' Retirement System of New Jersey (P.L.1954, c.84; C.43:15A-1 et seq.).

    2. Section 56 of P.L.1977, c.110 (C.5:12-56) is amended to read as follows:

    56. a. The Attorney General shall organize the work of the division in such bureaus and other organizational units as he may determine to be necessary for efficient and effective operation and shall assign to the division such employees of the Department of Law and Public Safety as may be necessary to assist the director in the performance of his duties. Subject to the approval of the Attorney General, the Superintendent of State Police shall assign such supervisory and investigative personnel and other resources to the Division of Gaming Enforcement as may be necessary to fulfill its obligations under this act.

    b. All employees of the division, except for [secretarial and clerical] the division director, executive assistants and other executive-level management personnel, shall be in the [unclassified] competitive division of the career service of the Civil Service. [All employees of the division shall be deemed confidential employees for the purposes of the "New Jersey Employer-Employee Relations Act" (P.L.1941, c.100; C.34:13A-1 et seq.), as amended.] If layoff actions are instituted, the division shall be the layoff unit and the Commissioner of Personnel shall determine job locations within the division.

    3. (New section) Except as otherwise provided, employees of the Casino Control Commission and the Division of Gaming Enforcement in the Department of Law and Public Safety who on the effective date of this act, P.L. , c. (C. ) (now pending before the Legislature as this bill), are in the unclassified service shall, on the date of the assignment of their titles to the career service, be appointed on an interim basis to the noncompetitive division of the career service. Upon completion of their respective working test periods, the employees shall be reassigned to the competitive division of the career


service and shall receive seniority based upon the length of continuous service with the commission or the division, as the case may be.

 

    4. This act shall take effect immediately.

 

 

STATEMENT

 

    At present, employees of the Casino Control Commission and the Division of Gaming Enforcement are, except for secretarial and clerical personnel, in the unclassified service of the civil service. In addition, all employees are deemed confidential employees for the purposes of the "New Jersey Employer-Employee Relations Act." This bill provides that all employees of the commission and the division, except for division directors, executive assistants and other executive-level management personnel, shall be in the competitive division of the career service of the civil service. It removes the provision which deems these employees to be confidential employees. The bill also provides that for layoff purposes, the commission and the division shall be layoff units and the Commissioner of Personnel shall determine job locations within the commission and the division.

    Employees now in the unclassified service shall, on the date of the assignment of their titles to the career service, be appointed on an interim basis to the noncompetitive division of the career service. Upon completion of their respective working test periods, the employees shall be reassigned to the competitive division of the career service and shall receive seniority based upon the length of continuous service with the commission or the division, as the case may be.
