The Senate Natural Resources and Economic Development Committee reports favorably and with committee amendments Senate Bill No. 580.
This bill would exempt any transfer station owned or operated by a county utilities authority from the rate regulation and jurisdiction of the Department of Environmental Protection as a public utility provided that the solid waste transfer operations at the facility commenced prior to December 31, 1986 pursuant to a publicly-bid and lawfully negotiated contract.
The committee amendments would update references in the bill to the Board of Public Utilities to the Department of Environmental Protection (DEP). Pursuant to Reorganization Plan No. 002-1991, and reaffirmed by Reorganization Plan No. 001-1994, the DEP is the sole agency responsible both for the environmental aspects of solid waste management and the economic or public utility regulation of solid waste collection and disposal activities in New Jersey.
