An Act concerning use of strollers in certain public facilities and supplementing Title 10 of the Revised Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. A person with permanent disability or limited mobility who holds an identification card issued by the Division of Motor Vehicles in the Department of Law and Public Safety pursuant to either P.L.1949, c.280 (C.39:4-204 et seq.) or P.L.1980, c.47 (C.39:3-29.2 et seq.) and who, due to that disability or limited mobility, needs to transport his child in a stroller is entitled to the use of a public facility, notwithstanding the facility's prohibition on the use of strollers, subject to the following conditions:

    a. The person shall not leave the stroller unattended;

    b. The person who transports a child in a stroller shall not be charged any extra fee or payment for admission to or use of a public facility;

    c. The person who transports a child in a stroller shall be liable for any damages done to the premises of a public facility by the stroller.

    As used in this section, "public facility" means a public facility as defined in section 5 of P.L.1945, c.169 (C.10:5-5), and "stroller" means a non-motorized, wheeled vehicle designed to push or otherwise transport a young child, including, but not limited to, a carriage, a folding-type umbrella stroller, or a full-size stroller.

 

    2. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill allows persons with disabilities who hold an identification card issued by the DMV pursuant to either P.L.1949, c.280 (C.39:4-204 et seq.) or P.L.1980, c.47 (C.39:3-29.2 et seq.) and need to push a young child in a stroller, to gain entry to public facilities which otherwise prohibit strollers. The person with disabilities may not leave the stroller unattended and is liable for any damages done to the premises of the public facility by the stroller. The facility may not charge any extra fees for the stroller. As used in this bill, a stroller would include a carriage, a folding-type umbrella stroller, or a full-size stroller.
