An Act concerning teaching staff members and amending N.J.S.18A:25-3.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. N.J.S.18A:25-3 is amended to read as follows:

    18A:25-3. No teaching staff member shall be required to perform his duties on any day declared by law to be a public holiday and no deduction shall be made from such member's salary by reason of the fact that such a public holiday happens to be a school day [and any term of any contract made with any such member which is in violation of this section shall be void]; provided that if the staff member's employment is governed by a contract which requires the employee to work a specified number of days and the district's non-negotiable school calendar includes the statutory holiday as one of the contractual work days, this provision shall not apply.

    2. This act shall take effect immediately and shall first apply to the 1996-1997 school year.

 

 

STATEMENT

 

    Under the provisions of a current statute, no teaching staff member may be required to work on any public holiday and no deduction may be made from the member's salary if the public holiday happens to be a school day. This bill exempts from the statute a member whose employment is governed by a contract which requires the employee to work a specified number of days and the district's non-negotiable school calendar includes the statutory holiday as one of the contractual work days.


                             

 

Excludes certain teaching staff members from paid absence on a public holiday.
