ASSEMBLY SUBSTITUTE FOR
SENATE, No. 852
with Senate Floor Amendments

The Assembly Substitute to Senate Bill No. 852 provides that a board of education shall not be required to award a contract to the lowest bidder if the board, because of a prior negative experience with that bidder, determines that it is not in the best interest of the district to do so.
This amendment provides that any final action taken by a board of education pursuant to the substitute's provisions must be taken in a public meeting at which the bidder being disqualified may appear and offer testimony. The amendment requires that the bidder be notified of the date, time and place of the public meeting.
