An Act concerning the removal of State Board of Education members and amending N.J.S. 18A:4-4.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. N.J.S.18A:4-4 is amended to read as follows:

    18A:4-4. a. The members of the state board shall be appointed by the governor, by and with the advice and consent of the senate, for terms of six years commencing on July 1, except as otherwise provided by section 18A:4-5. Each member shall continue in office after the expiration of his term until his successor is appointed and has qualified, and in any such case and in case of any vacancy the successor shall be appointed in like manner for the unexpired term only.

    b. When any member of the state board fails to attend three consecutive quorum call meetings of the board without good cause he may be removed from office by a two-thirds majority vote of those board members holding office. Upon the removal from office of a state board member, the governor shall appoint a replacement to the state board in accordance with subsection a. of this section.

    2. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill provides that when any member of the State Board of Education fails to attend three consecutive quorum call meetings of the board without good cause he may be removed from office by a two-thirds majority vote of the board members. The Governor shall appoint a replacement to the State board for the unexpired term of the member that is removed.

                             

Permits the removal of State Board of Education members.
