SENATE, No. 1039

      The Assembly Local Government Committee reports favorably the Senate Committee Substitute for Senate Bill No. 1039.

      The bill eliminates certain requirements regarding the publication of municipal public notices in newspapers.

      Under current law, public notices that a municipality, other than a city, may be required by law to publish shall be published in at least one newspaper published and circulating in the municipality, and if there be no such newspaper, then in at least one newspaper published in the county in which the municipality is located and circulating in the municipality.

      The bill eliminates the requirement that preference for the publication of such notices must first be given to at least one newspaper published and circulating in the municipality before being given to a newspaper published in the county and provides instead that the notice only be published in at least one newspaper published in the county in which the municipality is located and circulating in the municipality.
