An Act providing for the terms of retirement of certain persons holding office under gubernatorial appointment who are members of the Public Employees' Retirement System and amending the title and body of P.L.1985, c.414.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. The title of P.L.1985, c.414 is amended to read as follows:

An Act providing for the terms of retirement of certain elected and certain appointed public officials who are members of the Public Employees' Retirement System and supplementing P.L.1954, c.84 (C.43:15A-1 et seq.).

    2. Section 1 of P.L.1985, c.414 (C.43:15A-47.2) is amended to read as follows:

    1. Notwithstanding any contrary provision of P.L.1954, c.84 (C.43:15A-1 et seq.), and except as may be otherwise provided in P.L.1972, c.167 (C.43:15A-135 et seq.), a member of the retirement system shall be eligible to retire while holding public office to which he was elected or to which he was appointed by the Governor and receiving the full salary for that office if his retirement allowance is not based solely on his service in the public office to which he was so elected or appointed, and no contributions shall be required of the member covering that service.

    3. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill permits a person who holds simultaneously a public office to which the person was appointed by the Governor and another public office or position of employment, both of which offices are covered by the Public Employees' Retirement System, to retire under the retirement system without being required to terminate service in the position subject to gubernatorial appointment.

 

 

 

Permits person to retire from PERS as holder of one public office or position of employment while retaining another PERS position held as gubernatorial appointee.
