An Act concerning compulsory education in the public schools and supplementing chapter 38 of Title 18A of the New Jersey Statutes.

 

      Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

      1. a. Notwithstanding any provision of law to the contrary, a municipality may require a child between the ages of six and 18 who has not earned a high school diploma to regularly attend the public schools of the district, upon the adoption of an ordinance by the governing body of the municipality or municipalities in which the school district is situate and the adoption of a resolution by the board of education of the school district.

      b. If compulsory attendance is required until the age of 18 pursuant to this section, then the provisions of chapter 38 of Title 18A of the New Jersey Statutes concerning compulsory attendance in the public schools shall be applicable.

 

      2. This act shall take effect immediately.

 

 

STATEMENT

 

      This substitute provides that notwithstanding any provision of law to the contrary, a municipality may require a child between the ages of six and 18 who has not earned a high school diploma to regularly attend the public schools of the district, upon the adoption of an ordinance by the governing body of the municipality or municipalities in which the school district is situate and the adoption of a resolution by the board of education of the school district.
