An Act concerning motor vehicle parking in certain cases and supplementing chapter 4 of Title 39 of the Revised Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. Notwithstanding the provisions of R.S.39:4-138, the governing body of a municipality, by ordinance, may permit the parking of passenger automobiles within 50 feet, but no closer than 30 feet, of a "stop" sign or traffic control signal.

 

    2. This act shall take effect immediately.

 

STATEMENT

 

    Many of the municipalities in New Jersey's more densely populated counties have serious parking problems.

    The purpose of this bill is to help alleviate some of those problems by permitting the governing bodies of municipalities to create additional parking spaces.

    Under the provisions of the bill, the governing body of a municipality may adopt an ordinance permitting the parking of passenger automobiles no closer than 30 feet from a "stop" sign or traffic control signal. Currently, the statutes prohibit any parking within 50 feet of a "stop" sign. The additional spaces created as a result of this bill should help congested municipalities address some of their most pressing parking needs.

    The bill, it is important to note, specifies that only passenger automobiles may park in the spaces which are established between 30 and 50 feet from a "stop" sign or traffic control signal. This restriction is incorporated as a safety factor. Passenger automobiles, because of their size and style, will not obstruct an approaching motorist's view of a "stop" sign or traffic control signal.
