An Act transferring the Division of Motor Vehicles from the Department of Transportation to the Department of Law and Public Safety and supplementing chapter 2 of Title 39 of the Revised Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. Notwithstanding the provisions of the "Executive Reorganization Act of 1969," P.L.1969, c.203 (C.52:14C-1 et seq.), the Division of Motor Vehicles in the Department of Transportation, together with its functions, powers and duties, is transferred to the Department of Law and Public Safety. All references in any law, order, rule, regulation, contract, proceeding, or otherwise, to the Division of Motor Vehicles in the Department of Transportation or the supervisor thereof, shall mean the Division of Motor Vehicles in the Department of Law and Public Safety or the director thereof. All transfers shall be made pursuant to the "State Agency Transfer Act," P.L.1971, c.375 (C.52:14D-1 et seq.).

 

    2. Pursuant to the "State Agency Transfer Act," P.L.1971, c.375 (C52:14D-1 et seq.), personnel assigned to the Division of Motor Vehicles in the Department of Transportation, together with all of its functions, powers and duties, are transferred to the Department of Law and Public Safety.

 

    3. This act shall take effect on the first day of the third month after enactment.

 

 

STATEMENT

 

    This bill transfers the Division of Motor Vehicles from the Department of Transportation to the Department of Law and Public Safety.

    On March 13, 1995, Governor Whitman, pursuant to the "Executive Reorganization Act of 1969," P.L.1969, c.203 (C.52:14C-1 et seq.), issued Reorganization Plan No. 002-1995 providing for the transfer of the Division of Motor Vehicles from the Department of Law and Public Safety to the Department of Transportation.

    Under the provisions of this bill, the division would be returned to the Department of Law and Public Safety.
