An Act concerning the suspension or revocation of registration certificates and driver's licenses and supplementing chapter 5 of Title 39 of the Revised Statutes.

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

    1. a. Whenever the director is required to notify a person that the registration certificate for a motor vehicle or that his driver's licence or driving privilege in this State may be revoked or suspended for a violation of any of the provisions of Title 39 of the Revised Statutes, that notice shall be given by certified mail, restricted delivery.

    b. Whenever the director shall issue a revocation or suspension of the registration certificate for a motor vehicle or the driver's license or driving privileges of any person, the notice of that revocation or suspension, as the case may be, shall be given to the holder of that certificate, license or privilege by certified mail, restricted delivery.

    2. This act shall take effect immediately.

STATEMENT

    This bill would require that whenever the Division of Motor Vehicles (DMV) either proposes to issue, or issues, a revocation or suspension of a person's motor vehicle registration, driver's license or driving privileges that the notice of that action, or proposed action, be delivered by certified mail, restricted delivery.

    Because notice is currently given by regular mail, there are instances where citizens, through no fault of their own, are unaware that their motor vehicle registrations or driver's licenses have been revoked or suspended by the DMV. Since a person is subject to enhanced penalties for operating a motor vehicle while on the revoked or suspended list, it is only fair that the DMV be required to adopt a more effective method of notifying individuals whose motor vehicle registrations, driver's licenses or driving privileges have been revoked

or suspended, or who may be subject to such revocations or suspensions. This bill would required that all such notices be given by certified mail, restricted delivery.

Requires that DMV suspension and revocation notices be given by certified mail.
