An Act providing for the purchase of certain service credit in the Public Employees' Retirement System.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. Notwithstanding any law, rule or regulation to the contrary, a member of the Public Employees' Retirement System who was employed by a county on or after July 1, 1978 in a federally funded nutrition program under the federal Older Americans Act of 1965, Pub. L.89-73 (42 U.S.C.§3001 et al.), and who immediately prior to such employment with the county was employed by a county college in the same or a similar federally funded nutrition program but was not enrolled in the retirement system while employed by the county college, may purchase credit for the service with the county college by submitting to the retirement system an application to make the purchase no later than 180 days following the effective date of this act, P.L. , c. (C. ) (now pending before the Legislature as this bill). The purchase shall be made in the same manner and be subject to the same terms and conditions provided for the purchase of previous membership service by section 8 of P.L.1954, c.84 (C.43:15A-8).

 

    2. This act shall take effect immediately and shall expire 181 days thereafter.

 

 

STATEMENT

 

    This bill provides that a member of the Public Employees' Retirement System who was employed by a county on or after July 1, 1978 in a federally funded nutrition program under the federal Older Americans Act of 1965, Pub. L.89-73 (42 U.S.C.§3001 et al.), and who immediately prior to such employment with the county was employed by a county college in the same or a similar federally funded nutrition program but was not enrolled in the retirement system while employed by the county college, may purchase credit for the service with the county college by submitting to the retirement system an application to make the purchase no later than 180 days following the effective date of this act. The purchase shall be made in the same manner and be subject to the same terms and conditions provided for the purchase of previous membership service (i.e., the employee must pay the "employee's share" of the cost of the purchase based upon the employee's age and salary at the time of the purchase).

    This act shall take effect immediately and shall expire 181 days thereafter.
