STATE OF NEW JERSEY

An Act concerning the assessment of certain charges by State agencies and supplementing Title 52 of the Revised Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. As used in this act, "State agency" means any department, division, board, bureau, commission, council, authority, office or other instrumentality in the Executive branch of State government funded by the annual Appropriations Act.

 

    2. 1[ Notwithstanding any law, rule or regulation to the contrary, if] a. Except as provided in subsection b. of this section or as expressly authorized by statute,1 a State agency 1that1 provides 1goods or1 services to 1[or performs functions for]1 another State agency or agency project 1[, the State agency providing the services or performing the functions]1 shall not assess or collect any funds from the user State agency or 1agency1project nor apply any charge for the provision of the 1goods or1 services 1[or the performance of the functions]1.

    1b. A State agency may assess or collect funds from a user State agency or agency project or apply a charge for the provision of the goods or services if the assessment or charge:

    (1) is based upon the costs of providing the good or service; or

    (2) is a standard fee for the good or service which is charged to persons and non-State agencies as well as to State agencies.1

 

    3. The provisions of this act shall not prohibit the Director of the Division of Budget and Accounting from transferring or crediting to any central data processing center any appropriation made to any State agency which has been appropriated or allocated to the State agency for its share of the costs of the data processing center, including the replacement of data processing equipment and the purchasing of additional data processing equipment.

 

    4. This act shall take effect 1[immediately] on the first day of July following its enactment1.

 

 

                             

 

Provides that State agency cannot assess another State agency for providing goods or services, except under certain circumstances.
