      The Senate State Government Committee reports favorably and with committee amendments Senate, No. 1695.

      This bill stipulates that if a State agency provides goods or services to another State agency or agency project, the State agency providing the goods or services shall not assess or collect any funds from the user State agency or project nor apply any charge for the provision of the goods or services.

      However, the bill does permit a State agency to assess or collect funds from a user State agency or agency project or apply a charge for the provision of the goods or services if the assessment or charge: 1) is based on the cost of providing the good or service; or 2) is a standard fee for the good or service which is charged to persons and non-State agencies as well as to State agencies.

      The provisions of this act shall not prohibit the Director of the Division of Budget and Accounting from transferring or crediting to any central data processing center any appropriation made to any State agency which has been appropriated or allocated to the State agency for its share of the costs of the data processing center, including the replacement of data processing equipment and the purchasing of additional data processing equipment.

 

COMMITTEE AMENDMENTS

      The committee amended the bill to delete from its application the performance of functions for a State agency by another State agency, to add to its application the provision of goods (as well as services) by a State agency to another State agency, and to permit a State agency to assess or collect funds from a user State agency or agency project or apply a charge for the provision of the goods or services if the assessment or charge: 1) is based on the cost of providing the good or service; or 2) is a standard fee for the good or service which is charged to persons and non-State agencies as well as to State agencies.
