An Act to validate certain proceedings of fire districts and any bonds or other obligations issued or to be issued pursuant to such proceedings.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. All proceedings heretofore had or taken by any board of fire commissioners or at any fire district meeting or election for the authorization or issuance of bonds or other obligations of the fire district, and any bonds or other obligations of the fire district issued or to be issued pursuant to a proposal adopted by the legal voters at such meeting or election, are hereby ratified, validated and confirmed, notwithstanding that notices to military service voters and to their friends and relatives and to persons desiring civilian absentee ballots were not published in accordance with the provisions of section 7 of the "Absentee Voting Law (1953)", P.L.1953, c.211 (C.19:57-1 et seq.), and notwithstanding that notices relating to such election were not properly prepared and were not posted and published as required by law; provided, however, that notices to the effect that an election would be held were published stating the date, time and place of the election; and provided, further, that any applications received by the clerk of the board of commissioners of the fire district for military service ballots or civilian absentee ballots for such election were forwarded to the clerk of the county in which such fire district is located; and provided, further, that no action, suit or other proceedings of any nature to contest the validity of such election have heretofore been instituted prior to the date on which this act takes effect and within the time fixed therefor by or pursuant to law or rule of court, or when such time has not heretofore expired, are instituted within 30 days after the effective date of this act.

 

    2. This act shall take effect immediately.


STATEMENT

 

    This bill is intended to validate the proceedings of the Montville Fire District No. 2, Morris County, bond issue notwithstanding that notices to military service voters and their friends and relatives and to persons desiring civilian absentee ballots were not published in accordance with the provisions of section 7 of the "Absentee Voter Law (1953)", P.L.1953, c.211 (C.19:57-7) and notwithstanding that the notice of election was not properly prepared, posted and published as required by law, provided that notices of election setting forth the date, time and place of the election were published and provided further that no action, suit or other proceedings of any nature to contest the validity of the election have been instituted prior to the date on which this act takes effect and within the time fixed therefor by or pursuant to law or rule of court, or when such time has not heretofore expired, are instituted within 30 days after the effective date of this act.
