SENATE COMMITTEE SUBSTITUTE FOR

SENATE, No. 1851

with Senate Floor Amendments

ADOPTED: JUNE 16, 1997

      This floor amendment omits certain language in paragraph (5) of subsection a. of N.J.S.2C:14-2 concerning the first degree crime of aggravated sexual assault. That language is considered redundant because the language already added by the substitute as new paragraph (7) concerning a victim whom the actor knew or should have known was physically helpless, mentally defective or mentally incapacitated will address this situation. This floor amendment conforms this substitute to the Assembly Committee Substitute for Assembly, No. 2725.
