SENATE JUDICIARY COMMITTEE

STATEMENT TO

SENATE, No. 1975

with committee amendments

STATE OF NEW JERSEY

DATED: MAY 8, 1997

The Senate Judiciary Committee reports favorably and with committee amendments Senate Bill No. 1975.

Under the “felony-murder” doctrine, set forth in subsection a. of 2C:11-3, a person who is engaged in the commission of certain enumerated crimes, such as sexual assault, arson, robbery, burglary or kidnaping, is guilty of murder if in the course of the crime, any person causes the death of a person other than one of the participants. This bill would add the crime of carjacking to this list of crimes.

The committee amendments would conform the provisions of S1975 with the provisions of recently enacted P.L.1997, c.60.
