An Act concerning the inspection and registration of motor vehicles and supplementing Title 39 of the Revised Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. As used in this act:

    "Commissioner" means the Commissioner of Environmental Protection.

    "NJIT report" means the problem summary and analysis completed by the New Jersey Institute of Technology concerning the testing program at Wayne, New Jersey, that was conducted pursuant to an agreement for special and technical services, entered into between the State of New Jersey, the Department of Law and Public Safety, the Division of Motor Vehicles, and the New Jersey Institute of Technology, on August 17, 1995, signed by C. Richard Kamin, Director, Department of Transportation, Division of Motor Vehicles, and Robert Pfeffer, Vice President for Research and Graduate Studies, New Jersey Institute of Technology, and bearing the title "New Jersey's Enhanced I/M Program."

 

    2. a. Notwithstanding the provisions of P.L.1995, c.112 (C.39:8-41 et seq.), or any other law, or any rule or regulation adopted pursuant thereto, to the contrary, no State agency, department or division thereof shall develop, implement or enforce any aspect of an inspection or registration program for motor vehicles established pursuant to P.L.1995, c.112, or implement or enforce any provision of any regulation adopted pursuant thereto, until the Department of Transportation has certified, pursuant to subsection b. of this section, that the problems with the inspection and emissions testing program enumerated in the NJIT report have been solved or the requirement, procedure or other element causing the problem has been removed from the elements of the inspection or registration program to be implemented in the State pursuant to P.L.1995, c. 112.

    b. The Department of Transportation, in cooperation and consultation with the Department of Environmental Protection, shall review the problems enumerated in the NJIT report and shall, within one year after the effective date of this act, solve the problem cited in the NJIT report or remove the requirement, procedure or other element causing the problem from the elements of the inspection or registration program to be implemented in the State pursuant to P.L.1995, c.112. Before or on one year after the effective date of this act, the Department of Transportation shall report to the Governor and the Legislature on the steps taken in response to the NJIT report and shall certify to the Governor and the Legislature that the problems cited in the NJIT report have been solved or the requirement, procedure or other element causing the problem has been removed from the elements of the inspection or registration program to be implemented in the State pursuant to P.L.1995, c.112.

 

    3. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill delays the development, implementation or enforcement of the inspection or registration program for motor vehicles established pursuant to the "Federal Clean Air Mandate Compliance Act," P.L.1995, c.112 (C.39:8-41 et seq.) until the Department of Transportation has certified that the problems with the emissions testing program enumerated in the NJIT report have been solved, and the Governor and Legislature have notified the Department of Transportation that the problems have been resolved to their satisfaction.
