An Act concerning the imposition of certain public utility fees and supplementing Title 48 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. As used in this act, an exit fee is a fee that a public utility imposes upon a ratepayer when that ratepayer leaves the public utility's system.
b. No gas, electric, or gas and electric public utility shall impose exit fees upon ratepayers unless and until such fees are authorized by an act of the Legislature.
c. The Board of Public Utilities shall not impose, or approve any petition from a gas, electric or gas and electric public utility for, an exit fee or fees unless and until such fees are authorized by an act of the Legislature.
d. The Board of Public Utilities shall review, evaluate and submit findings and recommendations concerning exit fees in a written report to the Governor and the Legislature on or before October 1, 1997.
2. This act shall take effect immediately .
STATEMENT
This bill would prohibit public utilities from imposing exit fees upon ratepayers who leave the utilities' system until the Legislature authorizes such fees. The bill also prohibits the Board of Public Utilities from imposing the fees or approving petitions from a gas, electric or gas and electric public utility for the fees. Finally, the bill directs the Board of Public Utilities to report to the Governor and the Legislature its findings and recommendations concerning exit fees by October 1, 1997.
