STATEMENT TO

 

SENATE CONCURRENT RESOLUTION No. 15

 

STATE OF NEW JERSEY

      The Assembly Policy and Regulatory Oversight Committee reports favorably Senate Concurrent Resolution No. 15. 

      This concurrent resolution embodies the finding of the Legislature that the amendment to N.J.A.C.7:1E-4.10(d) proposed at 27 N.J.R.2337 by the Department of Environmental Protection requiring that maps submitted as part of a Department of Environmental Protection Discharge Prevention, Control, and Countermeasure (DPCC) plan pursuant to the "Spill Compensation and Control Act," ("Spill Act"), P.L.1976, c.141 (C.58: 10-23.11 et seq.), be resubmitted in both digital and paper form is inconsistent with legislative intent. It is the committee's understanding that the Legislature did not intend to impose an additional requirement.

      The State Constitution provides that after the Legislature's adoption of this concurrent resolution, the Commissioner of Environmental Protection would have 30 days following transmittal of this resolution to amend or withdraw the proposed regulation, or the Legislature may, by passage of another concurrent resolution, exercise its authority under the Constitution to invalidate the proposed regulation in whole or in part.

      This Senate concurrent resolution is identical to Assembly Concurrent Resolution No. 68 also reported by this committee on this date.
