SENATE CONCURRENT RESOLUTION, No. 32

A Concurrent Resolution proposing to amend Article IV, Section IV, of the Constitution of the State of New Jersey.

 

    Be It Resolved by the Senate of the State of New Jersey (the General Assembly concurring):

 

    1. The following proposed amendment to the Constitution of the State of New Jersey is hereby agreed to:

 

PROPOSED AMENDMENT

 

    Amend Article IV, Section IV, by adding a new paragraph as follows:

    10. Whenever a nomination and appointment by the Governor shall require the advice and consent of the Senate, the Senate shall approve or disapprove the nomination and appointment in open session with a quorum of its members present within 90 days after the nomination has been received by the Senate, unless the nomination has been disapproved by a committee of the Senate in open meeting with a quorum of its members present. In the event the Senate shall be in temporary adjournment on the ninetieth day, the Senate shall approve or disapprove the nomination and appointment on the day it shall next reconvene. All nominations and appointments neither approved nor disapproved during an annual session of the Senate shall not be considered in a subsequent annual session without being submitted again to the Senate by the Governor.

 

    2. When this proposed amendment to the Constitution is finally agreed to pursuant to Article IX, paragraph 1 of the Constitution, it shall be submitted to the people at the next general election occurring more than three months after the final agreement and shall be published at least once in at least one newspaper of each county designated by the President of the Senate, the Speaker of the General Assembly and the Secretary of State, not less than three months prior to the general election.

 

    3. This proposed amendment to the Constitution shall be submitted to the people at that election in the following manner and form:

    There shall be printed on each official ballot to be used at the general election, the following:

    a. In every municipality in which voting machines are not used, a legend which shall immediately precede the question, as follows:

    If you favor the proposition printed below make a cross (X), plus (+) or check () in the square opposite the word "Yes." If you are opposed thereto make a cross (X), plus (+) or check () in the square opposite the word "No."

    b. In every municipality the following question:

Shall the amendment to Article IV, Section IV, agreed to by the Legislature, requiring the State Senate to act on nominations submitted by the Governor within 90 days, be approved?

 

 

INTERPRETIVE STATEMENT






 

NO

This amendment would require the State Senate to vote to approve or disapprove any nomination submitted by the Governor within 90 days of the nomination's submission unless the nomination has been disapproved by a committee of the Senate in an open meeting.

 

 

                                              SCHEDULE

 

    This constitutional amendment shall become part of the Constitution on the second Tuesday in January following the election at which it is approved.

 

 

STATEMENT

 

    This constitutional amendment would require the State Senate to vote to approve or disapprove any nomination submitted by the Governor within 90 days unless the nomination has been disapproved by a Senate committee.


 

Requires the Senate to vote on gubernatorial nominations within 90 days.
