STATE OF NEW JERSEY

A Joint Resolution designating Chapter 223 of the Laws of 1993 as the "Judge David J. Schroth Act."

 

Whereas, On March 1, 1997, the Honorable David J. Schroth retired from the Superior Court after sixteen years of service as a judge; and

Whereas, Judge Schroth, a native of Trenton, in addition to his service on the Superior Court, also served as a municipal court judge and as a judge of the former juvenile and domestic relations court; and

Whereas, A graduate of Fordham College and Fordam Law School, Judge Schroth, dubbed "Maximum Dave" by the press, is best known for his many years of service on the criminal bench in Mercer County; and

Whereas, Judge Schroth publicly expressed his frustration with the New Jersey Supreme Court's decision in State v. Yarbough, 100 N.J. 627 (1985), which placed limitations on the length of sentences which could be placed on defendants being sentenced for multiple offenses; and

Whereas, On August 5, 1993, Chapter 223 of the Laws of 1993 eliminating the Yarbough limitations on the length of sentences for defendants convicted of multiple offenses was enacted; and

Whereas, It is altogether fitting and proper that the legislation eliminating restrictions on the length of sentences which can be imposed on defendants convicted of multiple offenses bear the name of a judge who in his career unstintingly strove to protect the citizens of New Jersey from violent criminal offenders; now, therefore,

 

    Be It Resolved by the Senate and General Assembly of the State of New Jersey:

 

    1. P.L.1993, c.223, which was approved August 5, 1993, shall be known and may be cited as the "Judge David J. Schroth Act."

 

    2. This joint resolution shall take effect immediately.


STATEMENT

 

    This resolution would designate P.L.1993, c.223 as the "Judge David J. Schroth Act."
