SENATE RESOLUTION No. 22

 

STATE OF NEW JERSEY

 

INTRODUCED FEBRUARY 26, 1996

A Senate Resolution memorializing Congress to refuse to appropriate any funds for any activity by the armed forces of the United States not specifically authorized by Congress and to refrain from any activity which subordinates the national sovereignty of the United States.

 

Whereas, The Constitution of the United States of America was ordained and established in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to the people of the United States; and

Whereas, This noble and timeless document clearly and unequivocally places the responsibility to defend the United States with the Congress of the United States in Article I, section VIII by specifying that the Congress shall have power to "...provide for the common defense, ...declare war, ...raise and support armies, ...provide and maintain a navy, ...make rules for the government and regulation of the land and naval forces, ...suppress insurrections and repel invasions"; and

Whereas, While it is clear that the Constitution of the United States permits the making of treaties with other nations, it is also equally clear that the sovereignty of the United States is inviolate and may not be made subordinate to any other nation or international organization; and

Whereas, The only legal method by which the sovereignty of the United States could be made subordinate to that of another nation or international organization would be by receiving the explicit consent of the American people expressed through the ratification of an amendment to the Constitution, specifically subordinating that sovereignty, by three-fourths of the states; and

Whereas, Opposition by the people of the United States to subordinating the sovereignty of the United States to that of another nation or international organization has always been intense, has been repeatedly manifested throughout our history, and remains a fundamental tenet of American society today; and

Whereas, A key component of the American people's implacable opposition to subordinating our national sovereignty to that of another nation or international organization is their awareness that while our Constitution has stood as a bulwark against numerous efforts to erode our independence and freedom, other nations and international organizations operate under systems and according to principles which are anathema to our principles of freedom and liberty; and

Whereas, It is imperative that the Congress of the United States responsibly carry out its duties as defender of the nation by insuring that no activity occurs under the authority of the United States which might serve to weaken our independence and national sovereignty; and

Whereas, In recent years we have witnessed a disturbing trend in which units of the armed forces of the United States -- the organization which protects our national sovereignty and our life, liberty, property -- have been deployed under the command of other nations or international organizations; and

Whereas, It is imperative that the Congress of the United States diligently exercise its constitutional responsibilities concerning our armed forces by strictly adhering to the directives of our Constitution, and to decisively thwart any and all attempts to infringe upon the Congress' exclusive constitutionally mandated defense prerogatives; now, therefore

 

    Be It Resolved by the Senate of the State of New Jersey:

 

    1.    This House strenuously urges the members of the United States Congress to diligently carry out their constitutionally mandated responsibility to defend our nation by refusing to appropriate any funds for any activity by the armed forces of the United States not specifically authorized by Congress.

 

    2.    This House calls upon the Congress to refrain from any activity, including the establishment of any public policy, which subordinates the national sovereignty of the United States to that of another nation or international organization, such as cooperating with, or fostering the establishment of, any form of global or world government whether that entity be in the form of an existing organization such as the United Nations or in the form of a new organization.

 

    3.    A duly authenticated copy of this resolution, signed by the President of the Senate and attested by the Secretary thereof, shall be transmitted to the President of the United States Senate, the Speaker of the House of Representatives, and every member of Congress elected from this State.


STATEMENT

 

This resolution calls upon the U.S. Congress to refuse to appropriate any funds for any activity by the armed forces not specifically authorized by Congress. This resolution also calls upon the U.S. Congress to refrain from any activity, including the establishment of any public policy, which subordinates the national sovereignty of the United States to that of another nation or international organization, such as cooperating with, or fostering the establishment of, any form of global or world government whether that entity be in the form of an existing organization such as the United Nations or in the form of a new organization.
