with Assembly Floor Amendments

      These floor amendments: 

      (1)  remove the requirement for the Department of Environmental Protection (DEP) to consult with the Director of the Division of Purchase and Property in the Department of the Treasury, in developing the guidelines required by the bill;

      (2)  specify that the guidelines to be developed, and updated, by the DEP concern recommended recovered material content percentages for use by State and local agencies when entering into contracts for the purchase of goods to encourage the purchase of goods made with recycled material, rather than to encourage the maximum purchase of goods made with the highest percentage of recycled material;

      (3)  provide that the Director of the Division of Purchase and Property and the Director of the Division of Property Management and Construction in the Department of the Treasury, and all State and local agencies having authority to contract for the purchase of goods or services would be required to ensure that all product specifications for new procurements advertised after the bill is enacted into law reflect the guidelines developed, or updated, if applicable and to the extent practical and feasible; and

      (4)  revise the applicability of the above-described requirement to delete several exceptions provided in the bill, and instead provide that the requirement would not apply to a contract entered into by a local contracting unit, if following the guidelines developed, or updated pursuant to the bill would increase the cost of the contract.
