STATEMENT TO
ASSEMBLY, No. 5749
with Senate Floor Amendments
(Proposed by Senator GREENSTEIN)
ADOPTED: DECEMBER 20, 2021
Assembly Bill No. 5749 requires specialized training for corrections officers who conduct sexual abuse investigations in State correctional facilities; imposes disclosure and recusal requirements on these investigators if they have a personal relationship with an officer being investigated; and prohibits federal Prison Rape Elimination Act (PREA) compliance officers from serving as investigators.
These Senate amendments clarify that only the correctional facility’s institutional federal PREA compliance manager is prohibited from serving as a sexual abuse investigator in the Special Investigations Division (SID). This allows SID staff who are involved with PREA compliance to be involved in and provide necessary guidance in sexual abuse investigations.
As amended, this bill is identical to Senate Bill No. 3821, also amended by the Senate on this same date.
