SENATE COMMITTEE SUBSTITUTE FOR

SENATE, No. 4080

STATE OF NEW JERSEY

      The Senate Budget and Appropriations Committee reports favorably a Senate Committee Substitute for Senate Bill No. 4080.

      This Senate Committee Substitute authorizes municipalities to adopt an ordinance declaring that an all-terrain vehicle (ATV) or dirt bike unlawfully operated on any public street, highway, or right-of-way is an immediate threat to the public health, safety, and welfare and to designate the ATVs or dirt bikes as contraband subject to forfeiture pursuant to current law. 

      The committee substitute provides that an ATV or dirt bike forfeited under the bill is to be disposed of in accordance with State law on disposal of forfeited property or, at the discretion of the entity funding the prosecuting agency, destroyed.
